1. Information on the collection and processing of your personal data.

Personal data is collected and processed through this website, and will be processed by ONTECNIA to (a) analyze the visits, traffic, and navigation of users through the web; (b) the attention and response to queries and requests through the contact addresses indicated; and (c) select and display advertising content, interactions, and other purposes through cookies, as specified below.

The personal data provided will be treated confidentially and will be incorporated into the information systems of ONTECNIA, which will adopt the necessary and appropriate technical or organizational techniques to ensure the privacy of those concerned, and in particular, to prevent improper access, manipulation, or deletion.

With regard to the processing of the different queries, complaints, and/or other requests received, the legal basis that legitimizes such processing is the execution of a pre-contractual relationship with the users and the consent given to that effect.

The processing of your data related to the analysis of visits, traffic, and navigation on this website, personalization of advertising content, and other treatments associated with the use of cookies and other similar tools or technologies, will take place by the provisions of paragraph 5 of this policy.

Additionally, this website uses social connectors, that is, third-party plugins that allow connecting this website with social networks or other similar services and sharing content, for which it is a prerequisite that the user has an account in the social network in question. The above also implies a flow of personal data between the referred social networks and ONTECNIA. The use of such connectors is voluntary. If you decide to use them, you will be authorizing the communication of personal data (IP address, navigation data, and information related to the content that the user has decided to recommend or share) to the referred social networks.

2. Data retention period

In general, ONTECNIA will keep your data for the time necessary to carry out the operations and treatments that correspond to the indicated purposes. We will keep your data duly blocked, until the prescription of the possible legal responsibility that could be arisen from the above.  All this without prejudice to those relating to the conservation of navigation data, which treatment and conservation take place in accordance with that indicated in paragraph 5.

3. Communication of personal data

Generally speaking, ONTECNIA will not communicate personal data to third parties without your express authorization, except in cases expressly permitted or required by law. We also inform you that no international transfer of personal data is foreseen, except for cookies. In these cases, prior to such transfer, the legally required measures and guarantees are adopted, including the consent of the affected party, the application of standard clauses in accordance with the criteria of the European Commission, or binding corporate rules.

4. Rights of the interested parties

Data subjects may at any time exercise their rights of access, rectification, opposition, deletion, limitation of processing, portability, and the right not to be subject to individualized decisions, in the cases and with the limitations provided for by law. To request any of these rights, you may contact us by e-mail at redaccion@bonviveur.es. ONTECNIA may request a copy of your National Identity Card or equivalent to verify your identity. We also inform you that you can make a complaint to the Spanish Data Protection Agency, in case you consider that the processing of your personal data is not adequate.

5. Use of cookies and similar technologies

This website uses cookies and similar technologies, which may involve the processing of personal data by ONTECNIA and third parties, both for traffic and navigation analysis purposes (number of pages viewed, search parameters, and interactions), as well as for statistical purposes. This analysis is in the principle of aggregated data, therefore, not linked to a specific identified user.

We also use cookies, data identification, storage, and retrieval tools to identify, select, and display advertising content. The processing of this data, in particular concerning behavioral advertising, involves profiling and segmentation of users based on interests, preferences, demographics, location, gender, and other factors of the user and third parties or their devices used to access the Internet, using data analysis and interpretation techniques, making inferences, and applying predictive models, all anonymously as it is not linked to specific user data unless specifically identified (for example, by providing specific data). The processing of these cookies, the information on their specific purposes, and their classification, the list of operators that access and process the data, and the management of your preferences and consent options are carried out through a consent management platform (consent management platform or CMP) that complies with the standards of the advertising and digital marketing industry represented by the Interactive Advertising Bureau (IAB).

In accordance with the provisions of Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce (hereinafter, LSSI), ONTECNIA is authorized to use data storage and retrieval devices (“cookies”) provided that the consent of users is obtained after having provided them with clear and complete information on their use.

The consent of the user is, therefore, the main -although not the only- legal basis that legitimizes both the installation and use of cookies and access to the data obtained by them and their subsequent processing. Such consent is obtained through positive action, distinguishing:

  • In the case of cookies and processing for traffic and navigation analysis purposes, or to identify, select, and display advertising content without personalization or with personalization based on general parameters or basic profiling (based on non-precise geographic location, demographic data by range, gender, devices used, and their configuration, content tagging, or title), consent will be given through any positive action that involves continuing navigation, such as accessing other pages.
  • In the case of cookies and treatments to identify, select, and display advertising content but through advanced analysis, profiling, and segmentation of users, in the terms and sense indicated in the last paragraph of the previous section, the provision of consent shall be made explicitly, through the consent management platform enabled. The same system will also be applied for the use of cookies to measure the performance of content or advertisements, to conduct market research to generate audience information, and to develop and improve services.

The rejection, blocking, or deletion of the above cookies will prevent us from performing an exhaustive analysis of browsing and web traffic, as well as the presentation of personalized content, but will not prevent the display of advertising.

5.1. What are cookies and what are they used for?

Depending on the length of time they remain activated:

Session cookies: these are temporary cookies that remain in the cookie file of your browser until you leave the website, at which time they are deleted.

Persistent cookies: these are stored internally on your device even when you stop browsing the website, and are consulted each time you make a new visit. A permanent cookie has a specific expiration date, at the end of which it will stop working.

According to their purpose:

Technical cookies: are those that allow the execution of functionalities, options, or services of the web, for example, controlling traffic and data communication, identifying the session, counting visits, using security features while browsing, or sharing content through social networks.

Preference or personalization cookies: are those that allow access to the service with predefined characteristics in function of criteria determined by the person responsible for the website, such as the language, the type of browser through which the service is accessed, and its regional configuration, among others.

Analysis or measurement cookies: are those that allow us to quantify the number of users, visits, or actions, and thus, perform the measurement and statistical and quantitative analysis of the use made by users of the website and its contents.

Advertising Cookies: they allow the management of the functioning of advertising spaces and insertions, without taking into account a specific user profile.

Behavioral advertising cookies: are those that store information related to the behavior of users obtained through the continuous observation of their browsing habits, allowing the development of a specific profile to display advertising in function thereof.

5.2. What specific cookies are used on this website?

We use our own and third-party cookies on this website. For advertising insertion, both traditional advertising techniques (buying space) and programmatic advertising are used, that is, by buying audiences (groups of aggregated users) in an automated manner, involving different agents, technologies, and platforms.

If the user authorizes the processing of his data for behavioral advertising, that is, those related to personalization, according to the categorization of the advertising industry standard, data processing will be carried out involving profiling, segmentation, structuring, and assessment of patterns and behaviors, based on user data obtained from their browsing habits, and their subsequent collation, analysis, interpretation, extrapolation, inferences, and application of predictive models, to evaluate or predict aspects related to their personal preferences, interests, or current or foreseeable behaviors. Within the above, there will be processing involving the association, combination, interconnection, or cross-referencing of the personal data of users obtained from different sources, both from the user (data provided in other environments or devices) and from others.

The user may, in any case, expand the above information about cookies, providers, and specific purposes, manage its preferences and consents, revoke permissions, or oppose the processing of data, all through the parameters or control panel of our consent management platform.

To manage the above settings and preferences, the processing of data using cookies under the framework or standard of the Transparency & Consent Framework of the advertising and digital marketing industry represented by the Interactive Advertising Bureau (IAB) distinguishes the following categories of uses or purposes:

1. Store or access information on a device

Providers cannot create a personalized advertising profile using this information for the selection of future advertisements without a separate legal basis which specific purpose was to create a personalized advertising profile. "Approximate" means that only an approximate location of, at most, within a radius of 500 meters is allowed.

3. Create a personalized advertising profile

A profile of you and your interests may be developed to show you personalized advertisements that are relevant to you.

To create a personalized advertising profile, providers may: (a) collect information about a user (including the past activity of the user, their interests, previously visited websites or applications, location or demographic information), to create or edit a user profile for use in personalized advertising; (b) combine this information with other previously collected information, including across different websites or applications, to create or edit a user profile for use in personalized advertising.

4. Select personalized ads

Personalized ads can be displayed based on your profile.

To select customized ads, vendors may select customized ads based on a profile of a user or other historical user data, including a past activity of a user, interests, website or application visits, location, or demographic information.

5. Create a profile for content personalization

A profile may be created about you and your interests to show you personalized content that is relevant to you.

To create a profile for content personalization, providers may: (a) collect information about a user, including the activity of a user, interests, site or application visits, demographic, or location information, to create or edit a user profile to personalize content; (b) combine this information with other previously collected information, including across different websites or applications, to create or edit a user profile to personalize content.

6. Select custom content

Customized content can be displayed based on your profile.

To select customized content, vendors may select customized ads based on a profile of a user or other historical user data, including a past activity of a user, interests, website or application visits, location, or demographic information.

7. Measure ad performance

The performance and effectiveness of the ads you see or interact with can be measured.

To measure ad performance, vendors may: (a) measure whether ads were delivered to a user and how the user interacted with them; (b) report on ads, including their effectiveness and performance; (c) report on users who interacted with ads using data observed during the interaction of the user with that ad; (d) report to publishers on ads displayed on their websites or digital property; (e) measure whether an ad serves in an appropriate (brand-safe) editorial context; (f) determine the percentage of the advertisement that had the opportunity to be watched and the duration of that opportunity; (g) combine this information with other information previously collected, including across different websites or applications.

Vendors may not apply user panel-based or similar audience information data to ad measurement data without an independent legal basis for using market research to generate audience information.

8. Measure content performance

You can measure the performance and effectiveness of the content the user watches or interacts with.

To measure content performance, providers may: (a) measure and report on how content was delivered and how users interacted with it; (b) report, using directly measurable or known information on users who interacted with the content; (c) combine this information with other previously collected information, including across different websites or applications.

LProviders may not: (a) measure whether ads (including native advertising) were delivered to a user and whether the user interacted with them without having an alternative legal basis to do so; (b) apply audience information data, based on a user panel or similar, to ad measurement data without an independent legal basis for using market research to generate audience information.

9. Use market research to generate information about the audience

Market research can be used to learn more about the audience visiting websites/applications and watching ads.

To use market research to generate audience information, suppliers may: (a) produce aggregate reports for advertisers or their representatives on the audiences reached by their ads, through audience panel-based, or similarly obtained, information; (b) produce aggregate reports for publishers on the audiences that were shown content and/or ads or interacted with them on their property, applying audience panel-based, or similarly obtained, information; (c) associate offline data with an online user for market research purposes to generate audience information if the providers have stated that they collate and combine offline data sources; (d) combine this information with other previously collected information, including between different websites or applications.

Providers may not: (a) measure the performance and effectiveness of ads that were shown to or interacted with by a specific user, without an independent legal basis for measuring ad performance; (b) measure what content was shown to and interacted with by a specific user, without an independent legal basis for measuring content performance.

10. Develop and improve products

Their data can be used to improve existing systems and/or software, as well as to develop new products.

To develop new products and improve products, suppliers can: (a) use the information to improve their existing products with new functionalities/features and develop new products; (b) create new models and algorithms through machine learning.

Providers may not, on the basis of this purpose, carry out any other data processing operation permitted by virtue of a different purpose.

In addition to the above purposes, the following are established:

A) Special purposes, the processing of which may be based on a legal basis other than consent, or be exempted from consent.

1. Ensure security, prevent fraud, and debug errors

Your data can be used to monitor and prevent fraudulent activities, and to ensure that systems and processes are operating correctly and securely.

To ensure security, prevent fraud, and debug errors, providers may: (a) ensure that data is transmitted securely; (b) detect and prevent malicious, fraudulent, unacceptable, or illegal activities; (c) ensure the proper and efficient operation of systems and processes, including monitoring and improving the performance of systems and processes used for permitted purposes.

Providers may not carry out any other data processing operations permitted by virtue of a different purpose. Data collected and used to ensure security, prevent fraud, and debug errors, may include device characteristics automatically sent for identification, accurate geolocation data, and data obtained by actively analyzing device characteristics for identification without further disclosure and/or independent acceptance.

2. Technically serve advertisements or content

Your device may receive and send information that allows you to view and interact with advertisements and content.

To serve information and respond to technical requests, providers may: (a) use the IP address of a user to deliver an advertisement over the Internet; (b) respond to the interaction of a user with an advertisement by sending the user to a landing page; (c) use the IP address of a user to deliver content over the Internet; (d) respond to the interaction of a user with content by sending the user to a landing page; (e) use information about the type of device and its capabilities to deliver advertisements or content, for example, to deliver the right sized advertising or video file in a format compatible with the device.

Providers may not carry out, according to this purpose, any other data processing operation permitted under a different purpose.

B) Functionalities

1. Collate and combine off-line data sources

Data obtained from offline data sources may be combined with your online activity to support one or more purposes.

Providers may combine data collected offline with data collected online in support of one or more Special Purposes or Purposes.

2. Link different devices

It can be determined that different devices belong to you or your household for one or more purposes.

Providers can (a) deterministically determine that two or more devices belong to the same user or household; (b) probabilistically determine that two or more devices belong to the same user or household; (c) actively analyze device characteristics to find their probabilistic identification if users have allowed providers to actively analyze device characteristics for identification (Special Functionality 2).

3. Receive and use for identifying the device characteristics that are sent automatically

Your device can be distinguished from other devices based on the information it sends automatically, such as IP address or browser type.

Vendors may: (a) create an identifier using data automatically collected on a device for specific characteristics, for example, IP address or user agent string; (b) use this identifier to attempt to re-identify a device.

Vendors may not: (a) create an identifier using data collected through active analysis of a device to find specific functionality, for example, installed fonts or screen resolution without independent user acceptance to actively analyze device characteristics for identification; (b) use this identifier to re-identify a device.

C) Special functionalities

1. Use accurate geographic location data

Your precise geographic location data may be used for one or more purposes. This means that your location can be accurate to within several meters.

Providers may collect and process precise geographic location data for one or more purposes. Precise geographic location means that there are no restrictions on the accuracy of a location of a user; this can be accurate to within several meters.

2. Actively analyze the characteristics of the device for identification

Your device can be identified based on an analysis of the unique combination of the characteristics of your device.

Vendors can: (a) create an identifier using data collected through active analysis of a device to find specific characteristics, for example, installed fonts or screen resolution; (b) use this identifier to re-identify a device.

5.2.1. Own cookies

In general, we inform you that we do not use our own cookies on this website.

Among the third parties ONTECNIA has contracted with for the provision of technological services that involve access to personal data through cookies or similar technologies, we highlight Google, LLC, provider of Google Analytics services. The data processing by Google is carried out in accordance with the provisions of https://policies.google.com/technologies/partner-sites.

5.2.2. Third-party cookies

Without prejudice to the above information, this website additionally includes so-called "third-party cookies", that is, cookies that are sent to the device of the user from a computer or domain not managed by ONTECNIA, but by third parties that capture, access, and process this personal data in accordance with the means and purposes that they establish, and are therefore responsible for the further processing that is carried out.

In case the user is interested in knowing these third parties whose cookies are installed on this website, you can access the control panel of our consent management platform, and within the section "know our partners", or by uses and purposes, you can find the list of agents, intermediaries, and content providers or advertising insertions and responsible for the processing of data according to the purposes indicated in each case. We also inform you that, next to the name of our partners, you will find a link where you can find more information about their identity and how they will treat your personal data. In the case of suppliers that are part of the International Advertising Bureau (IAB), there is a prior verification process by this entity that guarantees their compliance with the requirements and European legal framework in relation to the processing of data.

By express consent, or where appropriate, following other legitimate bases for processing indicated in this document, the corresponding third-party cookies will be installed to allow access and subsequent data retrieval. Please, note that this may involve the existence of international transfers of your data outside the Economic Area.

In addition, and given that most of these cookies or technologies applied are advertising, in particular behavioral or programmatic advertising, we inform you that the installation of these third-party cookies may entail the existence of further automated data processing that may produce legal effects on data subjects or significantly affect them within the meaning of European data protection regulations.
